Summary of Member Meeting

Meeting Date: October 21, 2015

Location: Associated Builders and Contractors (ABC) of Wisconsin, Madison, Wisconsin

The meeting was convened at 9:10 a.m. by Bob DuPont, of Regulatory Guidance and Design, LLC.

Regarding possible carbon monoxide update legislation DuPont reported that he and Chief David Bloom met with Representative Samantha Kerkman on October 14th to request she introduce a bill to update state statutes dealing with carbon monoxide detection in residential commercial buildings. Representative Kerkman said she would have a bill drafted and would seek a Senate Co-author.

Regarding the idea for owner’s choice of code application DuPont asked ARC members to report to him any cases where potential building owners wanted to use the newer national model codes instead of the present Wisconsin Commercial Building Code. He said it would be helpful to have real life examples of the problem that the owner’s choice proposal is trying to address.

There was agreement that DuPont should contact other organizations as potential partners in this effort. Progress on those communications will be discussed during the next ARC Member Meeting.

Regarding the draft Building Inspection Mutual Assistance Agreement drafted by Wisconsin Division of Emergency Management, attendees agreed that ARC should recommend use of the same four geographical regions used by the four building inspector associations in the state; instead of the six regions now used by WEM, and the Wisconsin Emergency Management Response Plan. DuPont said he would verify those four regions and would communicate this new recommendation to the team working on the Building Inspection Mutual Assistance Agreement with WEM.

Regarding pending legislation DuPont recapped the status of the following legislative proposals.
  • AB 190; Electrician licensing – The Assembly Labor Committee voted in favor on 10-7-15.
  • SB 87; Renovations to UDC dwellings – Passed the Senate on 9-16-15.
  • SB 81; Restrictions on municipal licensing of occupations – Passed the Senate on 6-9-15. It has been referred to the Assembly Committee on Rules for scheduling of an Assembly floor vote.

Regarding DSPS code development progress members discussed the following points.
  • Commercial Building Code – Richard Paur reported that the commercial building code committee is almost done with their initial review of the 2012 and 2015 editions of the International Building Code. They still have to address IBC Chapter 34 dealing with existing structures and IBC Chapter 17 dealing with special inspections. Next they will review the International Existing Buildings Code.
  • Electrical Code – The code committee has met twice; with DSPS now saying they would like to target the 2017 National Electric Code for adoption. Rachel Jaeb reported that the DSPS did not originally appoint a representative of the National Electrical Contractors Association-Wisconsin Chapter to the committee. They have historically had a member on the committee. Secretary Ross said he would appoint a NECA-WI representative as soon as possible.
  • Plumbing Code and Public Swimming Pool Code – Per Hannah Zillmer, of the DSPS, the department is in the process of forming advisory code committees for updating these codes.
  • SPS 360, Soil Erosion for Commercial Building Construction Sites – DuPont reported that this chapter has not been revised to reflect the 2013 Budget Act which transferred regulation of large construction sites (one acre or more of land disturbance) to the DNR. Richard Paur said he will ask members of the Wisconsin Code Officials Alliance whether this has presented a problem to them. DuPont said he will check with John Schulze and John Mielke of the Associated Builders and Contractors, Wisconsin Chapter to them the same question.

The next meeting of Alliance Members was scheduled for February 3, 2016, from 9:00 to 10:30 a.m. The meeting will be held at the offices of the Associated Builders and Contractors of Wisconsin.
