Alliance for Regulatory Coordination Summary of Member Meeting Meeting Date: July 22, 2015 Location: Associated Builders and Contractors (ABC) of Wisconsin, Madison, Wisconsin The meeting was convened at 9:04 a.m. by Bob DuPont, of Regulatory Guidance and Design, LLC. Attendees introduced themselves and identified the organizations they were representing. Regarding the provision in 2015 Wisconsin Act 55 which prohibits time of sale requirements, DuPont started the dialogue by asking if municipal orders to repair defects transfer from old to new owners of the property. Richard Paur said the City of Milwaukee reissues orders to the new property owners. Joel Meier said there is often a lag time of weeks or months before code officials learn the identity of the new building owner. There was general recognition that the new law does not prohibit issuance of corrective orders. However, the new law does prohibit such orders from restricting sale of the property and it prohibits orders from containing deadlines for performing corrective measures within a certain period of time after selling, refinancing, or transferring title to, a property. Richard Paur noted that the new law applies to any type of building, not just one- and two-family dwellings. DuPont asked if anyone felt the new law would affect initial occupancy permits in the case of turn-key construction. Richard Paur, Scott Satula and Tom Johnson all indicated they did not feel that was the case. DuPont asked if there was interest in having dialogue with Tom Larson, of the Wisconsin Realtors Association, about their intent when they requested this change to state law. There was agreement that such dialogue would likely be helpful, and suggestions for dialogue topics were made. DuPont said he would contact Tom Larson and initiate dialogue on the topics identified by the group. He suggested it might be helpful for Tom to attend the next ARC member meeting. Regarding pending legislation DuPont recapped the status of the following legislative proposals. The group decided that additional actions by the Alliance are not needed at this time.
Discussion centered on progress and next steps related to: legislation for carbon monoxide detectors in residential commercial buildings; possible legislation that would allow a building owner the choice of having newer national model codes and standards apply to their building construction project; and promulgation of administrative rules for credentialing inspectors of safety systems as required by law. Discussion included the idea of adding a new ARC priority to the list. DuPont recommended that exploration of the idea for statewide inspection of commercial building construction be added as a priority. He recounted that this topic was previously worked on by members of the ARC Fire Safety Team and was put on hold in due to the development of Act 270. After brief discussion, and recollection of past efforts in this regard, there was consensus among attendees to add this topic to the list of ARC priorities. The next meeting of Alliance Members was scheduled for October 21, 2015, from 9:00 to 10:30 a.m. The meeting will be held at the offices of the Associated Builders and Contractors of Wisconsin. The meeting was adjourned at 10:40 a.m.
